Greenbelt Waiver Form

All participants must sign this document and a parent or legal guardian must also sign if the participant is under the age of 18.

In consideration of accepting my participation, I hereby waive any and all claims that I may have against Essex County Greenbelt Association (ECGA), its volunteers, staff and board members and any and all other persons and organizations affiliated with this event, including but not limited to the organizers and supporters of the event and ECGA board members which arise from my participation in and travel to and from the event and from my use of ECGA’s equipment or facilities.

I (participant and parent/guardian of a minor) understand that ECGA’s educational and recreational activities may include, but are not limited to, hiking, paddling, foraging, Nordic skiing and snow-shoeing. The leaders of these activities are often volunteers rather than paid professionals. Participants, therefore, must take responsibility for their own safety and for having the appropriate skills, physical conditioning, equipment and supplies for the activities involved in the event.

Activities associated with the event may include inherent and other risks, hazards and dangers that can cause or lead to injury or property damage to participants or others.

Some, but not all of these risks include: hazardous and unpredictable terrain, water or weather conditions; misjudgments made by leaders, participants or others; travel in remote areas that can cause potential delays or difficulties with transportation, evacuation and medical care; equipment that can fail or malfunction; the potential that the participant or others (e.g. other participants, medical and rescue personnel) may act carelessly or recklessly.

I understand that ECGA cannot assure my safety or eliminate these risks. By participating in the event, I (participant and parent/guardian of a minor participant) assume and accept full responsibility for all risks associated with the event and its activities(both known and unknown) and for any injury, damage, death or other loss suffered as a result of participation in the event.

I grant permission to ECGA to utilize my image or likeness or recordings of this event or its activities. ECGA reserves the right to cancel the event due to inclement weather or unforeseen circumstances.

PARTICIPANT AND PARENT OF A MINOR PARTICIPANT AGREE: I HAVE CAREFULLY READ, UNDERSTAND AND VOLUNTARILY AGREE TO THE TERMS OF THIS DOCUMENT AND ACKNOWLEDGE THAT IT SHALL BE EFFECTIVE AND BINDING UPON ME, MY MINOR CHILDREN AND OTHER FAMILY MEMBERS, AND MY HEIRS, EXECUTORS, REPRESENTATIVES AND ESTATE.
